Property owners represented by the firm argued that the City of Charlotte exceeded the scope of its authority in charging water and sewer capacity use fees. The trial court and Court of Appeals agreed, and the North Carolina Supreme Court denied Charlotte’s petition for discretionary review. As a result, Charlotte was required to return $106,000,000 in fees to more than 5,000 property owners.
